One of the key projects our Team assisted the Client with is the Project for the reconstruction of the Zhambyl Irrigation network in Alakol district, Almaty, Kazakhstan. The legal support included drafting a complicated consortium agreement of the EPC contractors domiciled in different jurisdictions. The Team have also assisted on tax and currency issues, preparing analysis of the Kazakhstan tax and currency legislation for the irrigation project, issues related to transfer of funds to the local branch from the head office in China, subcontract issues, developing most appropriate options feasible from Kazakhstan currency regulation, including analysis of tax implications.
The Project has both international and republic significance. CCECC performs international contracting and economic cooperation and has been developed from the earlier Foreign Aid Department of the Ministry of Railways of China into a large-scale state-owned enterprise for project contracting. Its business scope expands from international contracting for railway construction to civil engineering design & consultancy, real estate development, trading, industrial investment, and hotel management as well.
The business activities of CCECC have expanded to over 40 countries and regions including Kazakhstan, where more than 20 overseas offices or subsidiaries have been established. With its excellent performance and high quality in services, CCECC has been listed among the world's top 255 international contractors for many years and ranked consecutively among the first 70 in recent years by the Engineering News Record "ENR".

Impact & Outcome

CCECC opened its branch in Kazakhstan in 2017, and since then, Unicase has been helping them to maintain the status of a construction industry leader. Together, the Client and Unicase contributed to the development of Kazakhstan industry, creating new jobs and introducing international practices and expertise into the market.
Reconstruction and modernisation of the Zhambyl Irrigation network in Alakol district successfully implemented by CCECC significantly influenced agricultural development in the region.

We rendered a full legal support to a Wolfram Mining Company, engaged in mining operations and producing the highest quality tungsten concentrate, and the production output of its deposit is about 2,238 thousand tonnes of ore a year.

In this Project, we acted as a legal adviser to the Kazakhstan Project Preparation Fund LLP, which is a sole consultant of the state authorities with respect to PPP projects in Kazakhstan.
Unicase advised the Kazakhstan Ministry of Health and the Public-Private Partnership Advisory Centre (KPPF) on a concession project for the construction and operation of a Multi-Disciplinary Hospital under Sd.
Unicase acted as a legal adviser to the Kazakhstan Project Preparation Fund LLP, which is an exclusive consultant of the state authorities, with respect to the PPP projects monitoring system in Kazakhstan.
We advised EBRD and a European Company on implementation of a Green City Action Plan in the cities of Semey and Ust-Kamenogorsk in the East Kazakhstan region.
The Unicase Team advised EBRD, IFC, the Ministry of Investment, and PPP Centre on the construction and operation of the “Almaty Bypass Road (BAKAD)” project, currently the largest public-private partnership project in Central Asia, US$680-million worth.
We advised EBRD and a European Company on implementation of a Green City Action Plan in the cities of Semey and Ust-Kamenogorsk in the East Kazakhstan region.
Unicase provided the Client with legal advisory services within a pilot project on building and operating a 100-megawatt solar power plant, based on a private bilateral sleeved PPA mechanism. In particular, we provided regulatory support on the Kazakhstan law governing the renewable energy sector, especially on the regulation of bilateral PPAs in Kazakhstan.
